These terms apply to the mobile game Neon Barrage (the "Game"), published by Andrija Rotter Kobasić (Kobasic), I. Vidovčica 11a, 10000 Zagreb, Croatia ("we", "us"). By installing or playing the Game, you agree to these terms. If you do not agree, please do not use the Game.
1. The Game
Neon Barrage is a free-to-play game for Android, distributed through Google Play. It contains ads and optional in-app purchases. The Game has no accounts, no online multiplayer and no user-generated content.
2. Age
The Game is intended for players aged 13 and older. If you are under the age of majority where you live, you should have a parent's or guardian's permission to make purchases.
3. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play the Game on devices you own or control, for your own non-commercial entertainment. You may not:
- copy, modify, decompile or reverse-engineer the Game, except where the law allows it
- sell, rent or redistribute the Game or its content
- use cheats, hacks, modified clients or automation to obtain coins, items or purchases
- remove copyright or other notices
All rights in the Game, including its code, art, music, sound and names, belong to us or our licensors.
4. Virtual items and currency
The Game contains virtual items, including:
- coins
- lives
- boosters
- Cores (ball styles)
- Arenas (board themes)
Some can be earned by playing, and some can be bought.
- Virtual items have no real-world monetary value. They cannot be exchanged for money, transferred, or sold outside the Game.
- You get a licence to use virtual items in the Game; you do not own them.
- Your progress and items are stored on your device only. If you uninstall the Game, clear its data or lose your device, your progress and consumable items (such as coins) may be lost. We cannot restore them, because there is no account or cloud save.
- Non-consumable purchases (Remove Ads, VIP, Starter Pack) are tied to your Google account and can be restored on reinstall through Google Play.
5. Purchases and refunds
- All purchases are processed by Google Play, under Google Play's terms and refund policy. Prices are shown in the Game and on Google Play, including any applicable taxes.
- For refunds, contact Google Play first (https://support.google.com/googleplay/answer/2479637). If you have a problem with a purchase, you can also email kobasic@gmail.com.
- If you are a consumer in the EU, you agree that digital content is delivered immediately after purchase. You acknowledge that you lose your 14-day right of withdrawal once delivery has started, to the extent permitted by law.
- Remove Ads removes interstitial ads. Optional rewarded ads stay available. VIP removes interstitial ads, doubles coins earned from levels and includes the Void Shard Core.
6. Ads
The Game shows ads provided by Google AdMob. Rewarded ads are optional, and they give an in-game bonus when watched to the end. How ad data is handled is described in our Privacy Policy: https://kobasic.dev/games/neon-barrage/privacy
7. Changes to the Game
We may update, change, balance or remove features, items, prices or content at any time, for example to fix bugs or improve the Game. We may also stop offering the Game. We will try to give reasonable notice of major changes through the Game or Google Play.
8. Disclaimer
The Game is provided "as is" and "as available". To the extent permitted by law, we do not guarantee that it will be error-free, uninterrupted or compatible with every device.
9. Limitation of liability
To the extent permitted by law, we are not liable for any indirect or consequential loss, or for loss of data or virtual items, arising from your use of the Game. Our total liability is limited to the amount you paid for in-app purchases in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, or your statutory rights as a consumer.
10. Termination
You can stop using the Game at any time by uninstalling it. If you seriously breach these terms (for example, through cheating or fraudulent purchases), we may withdraw your licence.
11. Governing law
These terms are governed by the laws of the Republic of Croatia. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence, and you may bring claims in the courts there. EU consumers may also use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr
12. Changes to these terms
We may update these terms. The date at the top shows the latest version. Continuing to play after an update means you accept the new terms.
